Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Cinq application and website (the "Service") operated by Cinq ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Program Description

Cinq is a social scheduling application that helps groups coordinate availability and plan events. The Service is available as a web application and an iMessage extension for iOS. Account creation requires phone number verification via SMS.

2. SMS Messaging Terms

By providing your phone number and creating an account, you consent to receive SMS messages from Cinq for the sole purpose of account verification. The following terms apply:

Message frequency: SMS messages are sent only when you request a verification code (typically once per sign-in). No recurring or marketing messages are sent.

Message and data rates may apply. Standard carrier messaging and data rates apply to all SMS messages sent and received.

Opt-out: You may opt out of SMS messages at any time by texting STOP to the number from which you received the message. After opting out, you will no longer receive SMS verification codes and may not be able to create new events until you re-enable SMS.

3. Account Registration

To create events, you must verify your phone number. You are responsible for maintaining the security of your account and for all activities that occur under your account. You must provide accurate and complete information during registration. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Service to: send spam, harass others, or distribute harmful content; attempt to gain unauthorized access to the Service or its systems; use the Service for any unlawful purpose; or interfere with the operation of the Service. We reserve the right to remove content or suspend accounts that violate these guidelines.

5. User Content

You retain ownership of content you create through the Service, including event titles, descriptions, and scheduling data. By using the Service, you grant us a limited license to store, display, and transmit your content as necessary to operate the Service. Event data is shared with participants you invite.

6. Intellectual Property

The Service, including its design, code, graphics, and branding, is owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our written permission.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Your phone number and personal data will not be shared with third parties for marketing purposes.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, if any.

10. Changes to These Terms

We may revise these Terms at any time by posting the updated version on this page. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will update the "Last updated" date at the top of this page.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law provisions.
